It’s by 2008 tax forms so yes she’s single.

The answers you are receiving are correct.
Remember that each FAFSA is based on income for the previous year – this year’s FAFSA asks about 2008 income.
Because your stepdad’s income and assets were not counted as household income and assets for 2008, his information will not be used to evaluate your financial circumstances for this year’s FAFSA.
As you correctly suggested, you’ll need to include his information next year, when you complete the 2010-2011 FAFSA, sometime this coming spring.

P.S.: Just to clarify: You’ll answer the question about your mom’s marital status by indicating that she is presently married (as of the date that you complete the form) and you’ll fill in the day that she married your stepdad (Questions 61 and 62), but you won’t provide financial info for your stepdad until next year.
The fafsa rules say “as of the date of the completion of the fafsa”. See page 50 on the link below.
But if it were me, I wouldn’t mention it until next year. If you don’t show your mom as remarried, you shouldn’t count him as a household member.
